These Terms and Conditions (“Agreement”) govern your access to and use of Zonara’s platform, website, and mobile application (collectively, the “Services”). This Agreement constitutes a legally binding contract between Zonara AS (“Zonara,” “we,” “us,” “our”) and you (“you,” “your,” “user”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must discontinue use of the Services immediately.

 

  1. Introduction

Zonara provides innovative solutions for fleet and asset management through a sophisticated platform designed to optimize operational efficiency. As part of our Services, we collect, process, and analyze data, including personal and telematics data, to deliver the features and functionalities outlined herein. The purpose of these Terms and Conditions is to ensure transparency regarding the Services we provide and to define the rights and responsibilities of all parties involved.

 

  1. User Eligibility

 The Services are intended for use by individuals who are at least 18 years of age or are authorized representatives of their respective organizations. By using the Services, you represent and warrant that you have the legal authority to enter into this Agreement. If you are using the Services on behalf of an organization, you confirm that you are authorized to bind that organization to these Terms.

 

  1. Data Collection, Use, and Ownership

 

3.1 Personal Identification and Verification

 As part of our Services, Zonara collects and processes Personal Identification Numbers (SSN) to verify driver eligibility. This verification process is conducted through an integration with the Norwegian Public Roads Administration (Statens Vegvesen, “SVV”) API. In instances where the SVV API fails or is unavailable, the collected SSN will be displayed to authorized users within your organization, who may manually approve the driver’s license in accordance with their designated user rights.

The SSN is securely stored and retained for purposes of future verification, compliance with legal obligations, and to facilitate the smooth operation of the Services. By using our Services, you consent to this data collection, storage, and use.

 

3.2 Vehicle and Telematics Data

 Zonara collects and processes data related to vehicle operation and driver behavior, including but not limited to:

Global Positioning System (GPS) data to track vehicle locations in real time.

Data on vehicle speed, driving patterns, usage, and performance.

Task management and maintenance records associated with vehicles and drivers.

This data is essential for delivering our core Services, which include tracking, analytics, and fleet optimization.

 

3.3 Ownership and Use of Data

 All data collected through Zonara’s Services is the sole property of Zonara. This includes both anonymized and identifiable data. By using the Services, you acknowledge and agree that Zonara has the right to:

Utilize anonymized data for internal research and development purposes.

Share or sell anonymized data to third parties, including but not limited to academic institutions, business partners, and industry stakeholders.

Develop, refine, and enhance the Services using the collected data.

Anonymization of data ensures that no individual or vehicle can be personally identified unless such identification is necessary for the operation of the Services or required by law.

 

  1. Data Security and Retention

 Zonara employs state-of-the-art security measures to protect the data collected through the Services. Personal and telematics data are encrypted during both storage and transmission. Access to this data is restricted to authorized personnel and users within your organization, as defined in the user roles and permissions framework.

While Zonara takes every reasonable precaution to safeguard your data, no system is entirely immune to breaches. By using the Services, you acknowledge and accept this inherent risk.

Zonara retains data for as long as it is necessary to fulfill the purposes outlined in this Agreement, comply with legal requirements, or resolve disputes. If you wish to request the deletion of certain data, please contact Zonara at the address provided below.

 

  1. Service Access and Responsibilities

 Your access to the Services is conditional upon your compliance with this Agreement. You agree to use the Services solely for their intended purposes and in accordance with all applicable laws.

You are responsible for maintaining the confidentiality of your account credentials and for ensuring that your organization’s user roles and permissions are appropriately managed. Zonara is not liable for unauthorized access resulting from your failure to safeguard these credentials.

 

  1. Service Availability and Limitations

 Zonara strives to provide uninterrupted access to the Services but cannot guarantee availability at all times. The Services may be temporarily suspended for maintenance, upgrades, or unforeseen technical issues. Zonara is not liable for any losses or inconveniences resulting from such interruptions.

 

  1. Liability and Indemnification

 To the fullest extent permitted by law, Zonara disclaims all liability for indirect, incidental, or consequential damages arising from your use of the Services. Zonara’s total liability for any claims related to this Agreement or the Services will not exceed the amount you paid for the Services in the 12 months preceding the claim.

You agree to indemnify and hold Zonara harmless from any claims, damages, or losses arising from your misuse of the Services or your breach of this Agreement.

 

  1. Intellectual Property

 All intellectual property associated with the Services, including but not limited to software, designs, and trademarks, is owned by Zonara or its licensors. Your use of the Services grants you no ownership rights. You may not copy, distribute, or reverse engineer any part of the Services without prior written consent from Zonara.

 

  1. Modifications to the Agreement

 Zonara reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website, and your continued use of the Services constitutes acceptance of the updated Agreement. It is your responsibility to review the Terms periodically.

 

  1. Termination

 Zonara may suspend or terminate your access to the Services if you breach this Agreement or if required by law. Termination of access does not absolve you of your obligations under this Agreement, including payment obligations.

 

  1. Governing Law and Dispute Resolution

 This Agreement is governed by the laws of Norway. Any disputes arising from or relating to this Agreement will be resolved exclusively in the courts of Norway.
